1.CONDICIONES GENERAL

The confirmation of the order by the purchaser carries the unqualified acceptance of these conditions of sale which take precedence over all previous versions or specifications issued by the buyer, including the exchange of e-mails.
These conditions may be modified, so it is recommended reading them prior to each order.

Products are presented in accordance with the legal recommendations and as accurately as possible.

There may be differences between the products delivered and those represented in the site or catalogue, mainly regarding what to handicrafts, whose homogeneity of manufacture cannot be guaranteed, or products that have been subject to adaptations related to technical or technological developments. Such differences, since they do not influence the basic characteristics of the products and do not affect its quality, will not justify a cancellation of the order or a refusal of delivery. Given that cannot guarantee an exact representation of the products in the website and/or in the catalogues, in particular due to differences in finish colors in Web browsing software or screens, Botanic not will be held responsible of the inaccuracy of the photographs used on the site.

2. ACCEPTANCE OF ORDER

The order is firm to the purchaser from the moment that confirms your order. For Botanic from validation of payment and confirmation of taking into account of the order.

2.1. MINIMUM ORDER

Botanic establishes a minimum amount per order. The sole purpose of this minimum amount is to cover the cost of each order and continue offering you an amount of decoration widest possible.

3. PRICE / PAYMENT

3.1 PRICE OF PRODUCTS

The prices appear in euros. Taxes related to the sale of products, including VAT are included. Prices are guaranteed until the publication of a new catalogue.

3.2 DELIVERY CHARGES

Botanic, inform the client via email, the costs of delivery on large items, such as furniture or very fragile items prior to your purchase.

3.3 PAYMENT

The payment will be made in its entirety to your order and only in euros, by bank card, or transfer unless otherwise noted, sent to the following address:

Payments by credit card are safe thanks to the payment solution through Dataphone Banc Sabadell. This solution allows the buyer make their purchases with total security. The bank details of the buyer that you make your payment by credit card will be not kept by Botanic and transmitted directly to Banc Sabadell.

As part of its action in favour of the fight against fraud in Internet Botanic may be taken to check the bank details or the identity of the clients before all delivery. To place your order on the website of Botanic, the customer undertakes to deliver to Botanic requested supporting documents. Lack of presentation of information requested by Botanic by the deadline, the latter reserves the right to cancel the order for such verification.

Payment with PayPal
PayPal is a secure payment that allows you to quickly pay the items without entering your bank details on the web site of the vendor. Just have them introduced to create your account at PayPal. The data is encrypted and remain forever in a secure environment. If you already have PayPal account you can use it on our Web site to pay for your purchases with total speed and security. Even if you don't have account with PayPal, you can choose this method of payment. At the time of making the payment, you will be redirected to a PayPal page where you can enter your bank details (and choose whether or not you create a PayPal account).

3.4 BILLING

The invoice to the buyer will take the data indicated by this in your customer account. The buyer can modify these data whenever you make a new order from the web site.

4 DELIVERY

4.1 DELIVERY MODES

When you make your order, indicate you the mode of delivery (by carrier or parcel post).

Delivery for packages: The delivery of your order will be made by a carrier specializing in delivery express. A dealer will go home after the expedition of the goods. The packages will be left at the door of your home. Prices do not include the direct delivery at domicile or installation. Your order will be delivered by packages in less than 10 days from the date mentioned on the page "available" at the time of processing your order.

Delivery by carrier: The delivery of your order will be made by a carrier specializing in the delivery of furniture. Your furniture will be delivered wrapped in boxes or pallets to ensure maximum protection. Our delivery service will contact you to set up a delivery date within the time limits mentioned in your order summary. Attention: before placing the order, you should check, especially as far as size and volume is concerned, that your products can transport by means of access to the place of delivery. We will give you articles appointment within a period of 15 working days approximately to small object and furniture 4-6 weeks long and when the order is availability. You will clearly provide an indicative delivery date when you make your order on our website. Our delivery service will contact you by telephone to arrange an appointment.

After the acceptance of the budget by the buyer and Botanic, the purchaser must mention the obstacles to a delivery by normal access roads (stairs, elevator doors in the landing) in the order form and remind the carrier. The buyer should verify previously the order, in particular in relation to the specifications of the products in term of size and volume, they can be transported by the access roads to the place of delivery.

The inability to deliver the goods on the agreed date by Botanic carriers, due to the absence of the buyer or of information about the need of specific means of delivery, may give rise to the payment of additional delivery charges and/or cancellation of the order by Botanic. Product risks are transferred to the purchaser at the time of delivery or the date of the first presentation of products by carriers from Botanic to the date of delivery agreed with the latter.

In cases in which dates of respective availability of products of an order were different, Botanic will propose the buyer split your order. In the case of fractioned delivery, participation in delivery costs referred to in point 3.2. It will be applied in each of the fractions of the order. Not to perform a fractional delivery delivery will speak at the date of availability of the ordered product.

4.2 RECEIPT AND CLAIMS

Upon receipt of the order, the buyer should proceed with all the necessary tests to detect possible faults, shortcomings, faults or other apparent defects, as well as the non-conformity of the goods delivered with your order. Save every receipt for purchase and transport for any claim.

So that your demand is not considered to be inadmissible, the purchaser must:

  • Indicate on the delivery note reserves arising from faults or shortcomings, and accurate since the General type "subject to unpacking" reserves are insufficient.
  • Confirm their reservations about faults or deficiencies and formulating other reservations, by registered mail with acknowledgement of receipt to the Botanic, Pineda de Mar, 08397 customer service.
  • Confirm your reservations about faults or deficiencies by certified mail with return receipt to the carrier, in the 2 days after delivery, holidays not included.

At the same time, the purchaser must return a copy of this claim to Botanic.

Also, buyer must to provide any proof that is required in relation to the reality of the filed claims and offer Botanic, their carriers or any person delegated by them, the necessary facilities to proceed with its finding; the buyer shall abstain to intervene or to speak to a third party for this purpose.

Accepted claims will lead to a change of the defective or non-conforming product, or your refund in the event of unavailability of the product in the store or with the suppliers. The returned product should give carriers of Botanic in perfect condition, in its equipped with all accessories and original packaging. No spontaneous return without the agreement of Botanic will not be accepted.

5 PRODUCTS WARRANTY / LIABILITY

5.1 WARRANTY COVERAGE

Furniture is guaranteed for a period of 1 year from its delivery against any defect of manufacture, design or material. However, you will have a period of two months from the delivery to communicate non-conformity, and in case that exceeded that time limit any damage and damages shall be borne by you. During the warranty period, Botanic undertakes, at its option, to Exchange or refund the product recognized as defective by their services. Changed products have warranty for the remaining period. The warranty does not include:

  • the damage to the product resulting from its normal wear and tear take account of its nature, its function, its composition and its price;
  • the slight differences observed in the products as defined in article 2.1;
  • Products that have been used too intensively, in particular for purposes which are not private;
  • all product defects that may result from a installation, storage, conservation, or defective installation (a) (non-observance of the Assembly instructions), a defect of maintenance, improper use or not compliant with technical specifications or use (non-observance of the recommendations for maintenance), modifications or repairs carried out by the purchaser or a third party, damage caused by foreign objects (TV too heavy on a piece of furniture not designed for such use) outdoor events such as accidents, blows, fire, acts of vandalism, damage caused by water, light natural or artificial (in the case of discoloration), natural disasters or weather conditions adverse.
  • From the date of purchase, sofas whose product card indicates that they enjoying a 2-year warranty are warranted:
  • 2 years for the structure, legs, screws, convertible sofa mechanism, background fabric and foam coating.
  • 1 year for the upholstery of the backrest and seat cushions.

5.2 IMPLEMENTATION OF THE WARRANTY

To apply the warranty, the buyer will contact service Botanic customer, at the following number: 937691616 or 937660212. The presentation of the original invoice will be required in order to enjoy the guarantee.

5.3 LEGAL GUARANTEES

Products are warranted against any defects of conformity and hidden defects under the conditions provided for by the provisions of the General Law of for the defence of consumers and users and the Civil Code.

6. RIGHT OF WITHDRAWAL

Right to withdraw from the purchase

You hire as consumer may withdraw from the purchase within a period of 7 working days from the date of delivery of the order. Once the Botanic withdrawal refund you the price paid for the products within a maximum period of 7 working days from the date of withdrawal.

The costs of returning the product shall be borne by the customer.

Any return by anomaly must be returned in its original packaging and without breaks.

Any amount will be refunded in the event that the product has been used or has been damaged in any way, so you must return the product in the same condition in which it was delivered, including all instructions, documents and wrappings of the product.

The formalization of the right of withdrawal of be carried out through a document that Botanic will put at your disposal once communicated its decision to withdraw from the purchase.

To exercise your right to opt out, the purchaser must return the form of withdrawal, which will be sent together with the invoice, service customer by certified mail with return receipt to the following address:

To coordinate a return, buyer must go to their customer account and access your order information. Next to the product in question, you should choose the option "Return a product" and indicate the reason for the return.

Return costs shall be borne by the buyer, except in cases of non-conformity with articles.

Botanic, on certain compositions reserves the right to send unfinished compositions/centres and will provide to customer a link and instructions, where can terminate the work. This is due to the transport, since there are compositions that are impossible to send mounted, according to the materials that make it up.
